mood: scared scared

I finally talked to my actual lawyer, not the secretary. I explained to her that my life is on hold and I need to get this over with. So she spent ten minutes being specific. She asked me to settle out of court in order to save court costs. I said "no way."
At least if I go to court I stand a little chance of winning.
She said to prepare to lose because the judge will rule in favor of the law and the law says Jack's kids are entitled to two thirds of every thing he owned.
So I am preparing myself mentally and emotionally to leave my home and security. But I'm going down fighting. I refuse to just sit back and let them walk all over me. But if that's what the judge rules then so be it.
I just hope my lawyer doesn't forget about me again. She said I should have a court date within two weeks, but fifteen months ago she said the whole thing would be over in two months, so I'm still waiting.

Is there any reason why you can't change lawyers, Inky?

This is so unfair! :-(

I could, Owl, but I can't afford another one. I do plan on asking the judge if I can speak for my self.

Two thirds? TWO THIRDS! Sheesh. I hate this for you. This seems SO unfair. Yeah...can you phone another attorney? Surely, there's a loophole or something.

I've been sniffing around trying to find out what I can. But so far it looks like she's right. Two thirds!

I agree with everyone else, can't you get another lawyer? That sucks big time. My sister-in-law got screwed when her husband left her. He'd been taking money without reporting it to the IRS. Well, she ended up having to pay the government thousands of dollars. The lawyer told her the same thing yours did--she'd lose. She didn't get another opinion and thus ended up moving back to my in-laws with her two kids. I really think you should go and talk to someone else. I'm sending major good vibes your way. I hope everything goes well for you. You don't deserve to be treated like this.

I'm so sorry! I wish I could do something to help, but all I can do is send good thoughts your way and hope that the judge doesn't blindly apply the law in this case.

Oh, Linda. I can't believe our justice system could be so heartless. It doesn't totally surprise me though. I will be praying HARD for you and your situation. I hope everything goes well.

Chin up, and don't give up. This seems so unfair! And I agree with the others that a second opinion might be a good idea -- your lawyer seems quite offhand, after stretching two months to fifteen. But I know lawyers don't always live in the 'real' world. Is it possible to phone around and get a thirty minute consult from someone, especially if you can find someone who specializes in this area? I would not settle just because this lawyer says you will lose, but is she going to fight for you, when her opinion is so negative? I'll be thinking power thoughts on your behalf. Best wishes!
